Rental Agreement

1. Payment

a. Rental Fee:  A Fee of $150 per hour with a two-hour minimum. The rental fee is due in full 2 days prior to the date of use. If event goes over the allotted time, renter will be charged for an additional $150 for each hour overtime.

If bartender/plant coach is requested a cost of $25 per hour per employee is added.

b. Cancellation/Refund: If cancellation by either party is more than 7 days before the scheduled use of the facilities, the rental fee and deposit will be refundable.  If Renter cancels within 7 days before the scheduled use of the facility, the deposit is nonrefundable.

c. Additional Charges: If any charges are incurred during the event, an additional invoice will be forwarded to the renter. Payment is due within 14 days of event.

2. Set Up - Clean Up - Decorations and Rented Equipment

a. Set Up: Access to the facilities for setting up, including catering set up, will be during the hours stated on the contract ONLY. Renter is allotted 30 minutes for set up before the event at no extra cost. If the renter or its vendors need additional time for set up, room decorating, etc. the renter may ask for access to the room beyond the contracted hours for an additional charge. Additional setup hours must be contiguous with event hours, i.e. additional set-up or breakdown time is only available for the hours immediately before or after the event. You must request this time in writing at least 14 days prior to your event. Additional set-up and breakdown time will be billed at the rate of one hundred dollars ($150.00) per hour or portion thereof. If set up is needed during closed hours, staff time will be charged to have the building open and a staff member present.

b. Clean Up: Renter is responsible for all clean up after the event. The premises must be left in the same a condition and repair as found at the beginning of the rental period. All food, beverages, equipment and rented supplies must be removed from the premises immediately after each use of the facility and no later than the exit time stated on the contract, or the renter will be charged an excess fee of $300 for cleaning services.

c. Decorations:

i. Displays, floral arrangements, decorations, musical equipment, and so on, must be free standing so as not to damage or deface the premises (no nails, tape, glue or other type of adhesive may be used.  No item may rest against or touch woodwork, walls or glass.)

ii. Decorations must be flame retardant to protect the premises and its contents.

iv. Dry ice or any other type of smoke generating devices are prohibited.

d. Furnishings

The following are included in the leasing fee and will be set up at your direction.

1.     5 rectangle tables
2.    30 barstools
3.    7 patio tables
4.   28 patio chairs
5.   Umbrella for patio

There will be an additional furniture removal fee of $200 if rented space is needed to be cleared before the event.

3. Food, Beverage and Products

a. Alcohol:

Open alcoholic beverages are strictly prohibited outside of the premises or the patio. Any alcohol beyond the premises may result up to a fine of $1000.  If any alcohol is brought onto The Succulent Shops property, management reserves the right to confiscate alcohol and stop all alcohol service at our bar. All alcoholic beverages must be purchased through The Succulent Shop. We offer OPEN BAR packages or CASH BAR with a $500.00 minimum. Please contact us for package options and rates.

Alcohol must be removed from the premises at the end of the event.

b. Smoking:

The entire facility is non-smoking, and we request, and will enforce, strict observance of this regulation.  Smoking will be allowed outside the facility in designated areas.

4. Food and Beverage Service

a. Catering: All food and beverage (excluding alcohol) served at any event must be cleaned up and removed at the end of the event. Trashcans are available for cleanup and we will dispose of trash bags at the end of the evening for you. For catering recommendations contact our staff for our updated list of recommended companies.

5. Music

Music must be played at a respectable volume and live music is not permitted unless arranged with The Succulent Shop prior to the agreement. The Succulent Shop has a right to terminate music if it is disruptive to the tenants and homeowners behind the premises.

6. Responsibility

a. Conduct: The conduct of all participants and spectators while on The Succulent Shop property shall be the responsibility of the renter.  The renter also accepts all responsibility for any injury to person(s) or property, or loss or damage to property or theft of personal property on The Succulent Shop premises during the rental period. Failure by any individual or group to follow all applicable rules and regulations will be cause for immediate eviction.  The Succulent Shop retains the right to evict objectionable persons from the premises.  Violations may result in denial of future reservation requests.

b. Occupancy: The rental party shall consist of Renter(s), Vendor(s) and attendees not to exceed 30 persons. Should the RENTER anticipate exceeding the 50 persons maximum, RENTER must obtain from OWNER or his AGENT no later than 7 days prior to EVENT a written approval for additional persons on the premises and pay in advance of EVENT any additional fees determined as result of exceeding the maximum occupancy. Should the OWNER or his AGENT learn of EVENTS exceeding the maximum occupancy, RENTER will be subject to forfeiture of all deposits and fees and may be immediately evicted from premises.

7. Liability.

RENTER agrees to pay for, in full, all damage to the facility or equipment that occurs during the outlined rental period. That includes the repair or adequate replacement of any object or facility damaged by the RENTER, any employee, performer or staff associated with the RENTER, as well as any paid or unpaid members, invitee or guest. Payment arrangements must be made within 14 days of the occurrence and all damages must be paid within 30 days of occurrence. Failure to abide by this measure may result in legal action. Tenant shall indemnify and hold The Succulent Shop harmless for any damage or injury which is caused by the fault or negligence of RENTER, its agents, employees, contractors or invitees or as to which the cause is unknown.

8. Loss to Property.

The Succulent Shop shall not be liable for any loss, theft or misappropriation of, or damage to, the property and equipment of RENTER occurring in connection with the Event or any Performance, and any such property or equipment located at or in the Facility will be there at the risk of the owner thereof. If necessary, RENTER agrees to carry sufficient insurance for any of RENTER’s property and equipment that RENTER brings into or adjacent to the Facility.

9. Staff. The Succulent Shop will NOT provide staff for RENTER’s event unless discussed and agreed otherwise. Staff can be utilized for an additional $50 per hour.
